This document (as well as other mentioned documents) regulates the terms governing the use of this Website (https://recuperat-ion.com) and the purchase of products and/or services therein (hereinafter, “Conditions”).
For the purposes of these Conditions, the activity that Sports Nutrition and Supplementation conducts through the Website includes:
Specialized nutritional supplements for hydration, muscle recovery, and general wellness for athletes and active individuals.
In addition to reading these Conditions, before accessing, browsing, and/or using this website, the User must have read the Legal Notice and General Terms of Use, including the Cookie Policy, and the Privacy and Data Protection Policy of Sports Nutrition and Supplementation. By using this Website or making a purchase request, the User agrees to be bound by these Conditions and all aforementioned documents. If the User does not agree, they must not use this Website.
These Conditions may be modified. The User is responsible for reviewing them each time they access, browse, or use the Website, as the Conditions in force at the time of purchase will apply.

2. THE USER
Accessing, browsing, and using the Website confers the status of User, implying acceptance of all Conditions herein, including any subsequent modifications, without prejudice to applicable legal requirements.

- Not making false or fraudulent purchases. Such purchases may be canceled, and authorities may be notified.

3. PURCHASE PROCESS
Users may purchase on the Website through established means. They must follow the online purchase procedure, selecting products/services and clicking “Complete Purchase.”
The User must fill in and/or verify requested information at each step, though data may be modified before payment.
The User will receive an email confirming order receipt and, where applicable, shipment confirmation. This information may also be available in the User’s account.
Upon purchase completion, the User consents to receiving an electronic invoice via email or their account. A paper copy may be requested via contact details provided.
The User acknowledges being aware of specific product/service conditions displayed on the Website (e.g., name, price, features) and that placing an order constitutes full acceptance.

4. AVAILABILITY
All orders are subject to product availability and force majeure. If supply issues arise, Sports Nutrition and Supplementation will contact the User and refund any amounts paid. This also applies if service provision becomes impossible.
5. PRICES AND PAYMENT
Prices are final, in Euros (€), and include taxes unless otherwise stated. Shipping costs are included.
No additional costs will be automatically added unless voluntarily selected by the User.
Prices may change but will not affect confirmed orders.
Accepted payment methods: Credit/debit card, PayPal, and Bank Transfer.
Sports Nutrition and Supplementation uses SSL encryption to ensure payment security. Card payments require bank authorization; failure may result in order cancellation.
A pre-authorization will be made to ensure sufficient funds. The card will be charged upon shipment confirmation.
For PayPal, payment is processed upon order confirmation.
Clicking “Complete Purchase” confirms the payment method belongs to the User.
Bank transfer orders are reserved for 5 natural days to allow processing. The User must ensure correct transfer details; errors will void the order.
6. DELIVERY
Deliveries are made within: Spain (Mainland and Balearic Islands).
Orders will be delivered within the timeframe indicated on the Website, based on the selected shipping method, and no later than 30 natural days from order confirmation.
If delivery cannot be met due to Sports Nutrition and Supplementation’s fault, the User will be contacted to reschedule or cancel with a full refund.
If delivery fails due to User absence, the order may be returned to the warehouse. A notice will be left for redelivery arrangements.
If the User cannot be present at delivery, they must contact Sports Nutrition and Supplementation to reschedule.
If 30 days pass without delivery due to non-User causes, the contract will be deemed terminated, and payments refunded (excluding additional shipping costs chosen by the User) within 14 natural days.
Return shipping costs may apply.
Delivery is considered complete when the User or a designated third party physically receives the products, confirmed by delivery signature.
Product risks transfer to the User upon delivery. Ownership transfers when full payment is received or upon delivery if later.
Per Spanish VAT Law 37/1992, orders delivered in Spain (excluding Canary Islands, Ceuta, and Melilla) are subject to applicable VAT rates.
7. TECHNICAL MEANS TO CORRECT ERRORS
Users may correct data entry errors by contacting Sports Nutrition and Supplementation via the Website or their account.
Before clicking “Complete Purchase,” Users can review and modify their cart.
Users are referred to the Privacy Policy for data rectification rights under GDPR and Spanish Organic Law 3/2018.
8. RETURNS
Users purchasing products through the Website have the following rights:
Right of Withdrawal
As a consumer, the User may withdraw from the purchase within 14 natural days without justification.
This period expires 14 days after the User (or authorized third party) receives the products or, for multiple items, the last product in the order.
To exercise this right, the User must notify Sports Nutrition and Supplementation via the Website or contact details.
The User may use the withdrawal form provided (not mandatory). The withdrawal period is met if the notice is sent before expiration.
Upon withdrawal, Sports Nutrition and Supplementation will refund all payments, including shipping (excluding additional costs for non-standard shipping), within 14 natural days.
Refunds will use the original payment method at no additional cost. Refunds may be withheld until product return or proof of return is received.
Products must be returned to: C/ Boule, 3, 43201 – Reus, Spain, without undue delay and within 14 days of withdrawal notice.
The User bears direct return costs and is responsible for value loss due to unnecessary handling.
Withdrawal rights do not apply to: customized products; perishable goods; unsealed audio/video recordings; hygiene/health products; digital content without physical support.
No refunds will be issued for used products or those not in original condition.
Products must be returned with original packaging, instructions, and a copy of the invoice.

Returns of Defective Products or Shipping Errors
If the User believes the product does not conform to the contract upon delivery, they must immediately contact Sports Nutrition and Supplementation to report the issue.
The User will be informed how to return the products, which will be inspected. A refund or replacement will be issued within a reasonable time.
Refunds or replacements will be processed as soon as possible, within 14 days of confirming the non-conformity.
For defective products, the full amount paid, including delivery and return costs, will be refunded via the original payment method.
Users retain all rights under applicable consumer laws.
Warranties
As a consumer, the User benefits from legal warranties for products purchased, covering non-conformities appearing within three years of delivery.
Products are deemed conforming if they match the description, are fit for purpose, and show expected quality. Non-conforming products may be returned as above.
For products from third-party brands, Users may contact the manufacturer directly to exercise warranty rights within three years of delivery, provided warranty information is retained.
9. LIMITATION OF LIABILITY
Unless required by law, Sports Nutrition and Supplementation is not liable for:
- Losses not attributable to its breach;
- Business losses (e.g., lost profits, revenue, contracts, data, goodwill, or unnecessary expenses); or
- Any indirect loss unforeseeable by both parties at contract conclusion.
Sports Nutrition and Supplementation also limits liability for:
- Minor discrepancies in product appearance due to screen resolution or browser issues.
- Transport issues (e.g., strikes, roadblocks) causing delays, loss, or theft.
- Technical failures or Website unavailability due to maintenance or force majeure.
- Misuse or wear of products by the User or incorrect returns.
- Force majeure events, including but not limited to:
- Strikes or labor disputes.
- Civil unrest, war, or terrorist threats.
- Natural disasters (fire, flood, earthquake, etc.).
- Transportation failures.
- Telecommunications failures.
- Government actions or restrictions.
Obligations will be suspended during force majeure, with an extension equal to the event’s duration. Sports Nutrition and Supplementation will make reasonable efforts to resolve issues.
10. WRITTEN COMMUNICATIONS AND NOTICES
By using the Website, the User agrees to electronic communications (email or Website notices).
Contracts, notifications, and other communications sent electronically comply with legal “written” requirements, without affecting User rights.

Sports Nutrition and Supplementation may contact Users via email or postal address.
11. WAIVER
No waiver of rights or failure to enforce strict compliance by Sports Nutrition and Supplementation constitutes a general waiver or releases the User from obligations.

12. NULLITY
If any Condition is declared void by competent authority, the remaining provisions remain in effect.
13. ENTIRE AGREEMENT
These Conditions and referenced documents constitute the entire agreement between the User and Sports Nutrition and Supplementation, superseding prior verbal or written agreements.
Both parties acknowledge entering the contract without reliance on any statements not expressly included herein.
14. DATA PROTECTION
Personal data provided during transactions will be processed per the Privacy Policy. By using the Website, the User consents to such processing and declares all information provided is truthful.
15. APPLICABLE LAW AND JURISDICTION
Access, navigation, and purchases on the Website are governed by Spanish law.
